The Divisional Court (Davis LJ, Foskett J and Holgate J) today handed down judgment, after a 6 day appeal hearing in July, dismissing the SRA’s appeal in SRA v Day and others.  The SDT had dismissed 20 allegations of misconduct against Leigh Day and a number of individual solicitors at that firm, after a 6 week hearing in 2017.  The SRA appealed in respect of 9 allegations (8 of which the SDT had decided by a majority) .  The judgment surveys the cases on the proper approach to such appeals and considers the relationship between rule breach and misconduct in the SRA’s regime.  Timothy Dutton QC (leading Andrew Tabachnik QC, Heather Emmerson and Nick Daly) appeared for the SRA and Patricia Robertson QC appeared with Paul Gott QC for the Respondents.  A copy of the Divisional Court’s judgment can be found here.
