Andrew Mitchell QC and Nicholas Medcroft succeed for RBS International in the Court of Appeal of Gibraltar in litigation arising from the infamous fraud committed by one of the territory’s major law firms. The trial judge had found RBS guilty of dishonestly assisting the law firm (Marrache Brothers) to steal money from client accounts held at RBS, in particular holding that the bank manager had actual knowledge that monies were being stolen but had kept quiet.  In an unusual interference with a judge’s findings of fact, the Court of Appeal was persuaded to set aside all the factual findings of dishonesty, considering they were unjustified on the evidence and a product of an unfair trial.
