Two such cases have now been tried in the courts, Green and Rowley v RBS and, the latest, Crestsign v NatWest/RBS. Andrew Mitchell QC represented the successful banks in both cases, instructed by Dentons and DLA. Both cases are leading authorities on banker’s duties of care, and Crestsign also involved the application of basis clauses and contractual estoppel.
