Primary Group v RBS and Direct Line – [2014] EWHC 1082 (Ch), LTL 23/4/2014 – Stephen Rubin QC successfully represented Direct Line in a 3-week trial (before Arnold J in the Chancery Division) of the claim by insurance company Primary Group for an alleged deliberate and knowing breach of confidence. The claim was dismissed against Direct Line. The judgment includes important dicta on the nature of the duty of a third party recipient of confidential information. On 12 May 2014 he obtained an order from Arnold J that Primary Group pay the costs of Direct Line on an indemnity basis.
