Bankim Thanki QC and Patrick Goodall appeared successfully for BNP Paribas in the Commercial Court in a major jurisdictional dispute with several Anchorage Capital hedge funds in the context of a claim relating to the sale of AIB subordinated private placement notes with the face value of $100 million. Anchorage had attempted to bring parallel proceedings in relation to the same subject matter in New York and disputed that the English courts had jurisdiction. BNP Paribas succeeded on all the issues before the Court, which also injuncted Anchorage from pursuing the New York proceedings.
