Adam Tolley successfully represented international luxury hotel group, Guoman, in a dispute about the jurisdiction of the Employment Tribunal to hear unfair dismissal and claims under the Employment Rights Act brought by a senior executive, Sanjay Nijhawan. In one of the first tribunal cases to apply the recent Supreme Court judgment in Ravat v Halliburton, the ET decided in Guoman’s favour that the claimant had been employed by a Chinese company and that in any event his employment was not sufficiently strongly connected with England to justify a conclusion that he had statutory employment rights.
