Bankim Thanki QC and Adam Sher, instructed by Freshfields Bruckhaus Deringer LLP (Andrew Hart and Sarah Burgemeister), have appeared for Bank Julius Baer in a multi-million dollar claim involving share transactions in a collapsed US pharmaceutical company. Mr Justice Roth, following a substantial trial in the Chancery Division, today ruled in favour of the Bank in the action brought by Winnetka Trading Corp against its former bankers. The claims, which included wide-ranging allegations of negligence against Julius Baer, were all dismissed by the Judge. The judgment is of particular interest in the way the Judge approached the implication of advisory duties into bank mandates (following cases such as JP Morgan Chase v Springwell Navigation).
