Ukrainian Aircraft Operator Policy Claims [2024] EWHC 1365 (Comm)

Acting (led by Derrick Dale KC and Christopher Langley) for various owners / operators of Ukrainian aircraft in multi-million dollar claims against All Risks and War Risks insurers in respect of aircraft stranded in Ukraine following the Russian invasion. The claims were the subject of a three-day jurisdiction challenge in the Commercial Court, and raised issues of foreign law in the context of jurisdiction clauses in reinsurance contracts.


Air Europa Líneas Aéreas, S.A.U. v BOC Aviation Limited

ThisCompany Ltd & Ors v Welsh & Ors

Acting (led by Craig Ulyatt) for the claimants and Part 20 defendants in a claim involving allegations of misappropriation of company funds and corporate mismanagement, against (amongst others) a former director and former shareholder of the claimant company. The claimants and Part 20 defendants successfully obtained summary judgment on part of the claim, and the majority of the Part 20 claim, in March 2025. The judgment considered the application of the Boston Deep Sea Fishing principle and the company’s rights under a shareholders’ agreement, in the context of the dishonest conduct of the first defendant.


Assisting (during pupillage) with research for opening submissions in an LCIA arbitration between a high net worth individual and their former wealth manager, involving allegations of breach of fiduciary duty, deceit and conspiracy.

The judgment involved consideration of the applicable test for an application to vary a court order where the alleged basis is a mistake in the drawing up the order.
