Recent Practice
Arbitration
Recently instructed (with Bankim Thanki QC) in an ICC arbitration concerning a joint venture to design and manufacture gas turbines. The case involves issues of the Tribunal’s jurisdiction as well as the underlying dispute.
Aviation
Regularly acts for airlines in claims brought by passengers under the Warsaw and Montreal Conventions.
Banking & Finance
Currently instructed (with Tim Howe QC) in a dispute arising out of the recent “credit crunch”, concerning the marketing of a CDO transaction to a Thai financial institution.
Regularly acts in retail and other banking disputes, including cases concerning fraud, guarantees and breach of mandate. Particular experience in acting for banks in resisting claims for the recovery of allegedly unlawful overdraft charges.
Commercial Litigation
Advised on and acted in various county court trials and applications. Subject matter has included sale of goods, construction, banking and bankruptcy.
Conflict of laws
Involved in several international commercial disputes raising issues of jurisdiction and choice of law.
European Law
Recently instructed (with Sir Francis Jacobs QC) in relation to the European Commission’s proposals to regulate the cost of international roaming services.
Human Rights
Recently instructed (with Sir Francis Jacobs QC) in two cases before the European Court of Human Rights, respectively concerning the right to private property and the right to liberty.
Insolvency
Acted for and advised both individuals and companies on a variety of insolvency matters.
Insurance & Reinsurance
Instructed (with Michael Crane QC and Nik Yeo) in an arbitration concerning a Lloyd’s directors' and officers' liability policy.
Professional negligence
Instructed (with Michael Brindle QC and Mark Simpson QC) in Stone & Rolls Limited v Moore Stephens (Commercial Court and Court of Appeal), which raises for the first time the question whether an auditor can rely on the defence of illegality when sued for failing to detect fraud in the audited company.
