This episode is hosted by Tetyana Nesterchuk and looks at some recent arbitration law decisions of the UK courts, including a number in which Fountain Court members were involved.

The discussion was recorded in January 2021 and covers the Supreme Court decisions in Halliburton v Chubb and Enka v Chubb, the Court of Appeal decision in A & Another v C & Others, and the recent decision arising out of a bilateral investment treaty arbitration in Kazakhstan v World Wide Minerals.

  • Baiju Vasani, a partner and Head of International Arbitration at Ivanyan & Partners. For over 20 years, Baiju’s practice focused exclusively on international arbitration and he serves as both counsel and arbitrator. He specialises in investor-state arbitrations including bilateral investment treaty claims. His work includes advising states on the negotiation and drafting of investment treaties, and investors on the structuring of their investments for maximum treaty protection. Baiju sits on the panel of several arbitral institutions, including ICSID.
  • Anneliese Day QC, a silk at Fountain Court Chambers who is described in the legal directories as “a leading lawyer of her generation” and a “standout genius”. She is frequently instructed in high-value and complex cases, as both counsel and arbitrator. She was awarded ‘International Arbitration Silk of the Year’ at the 2020 Chambers Bar Awards, has previously been listed as one of the 500 most influential people in the UK by Debretts, and is ranked as a Leading Silk in six practice areas in the legal directories, including of course international arbitration. Her experience spans numerous jurisdictions including the UK, Asia, the Middle East, Europe and the Caribbean.
