The latter client group is often advised on questions of local authority vires; constitutional and standards issues; financial controls; and judicial review.
Members’ court work is principally based in the Administrative Court, the Court of Appeal, and the Supreme Court, where members have achieved judicial recognition for the quality of their submissions.
Previous cases include Cookson & Clegg v Ministry of Defence (procurement remedies), R (Western Riverside Waste Authority) v Wandsworth LBC (charging for waste disposal).
High-profile advisory clients include numerous waste disposal authorities, the GLA on procurement policy, and Westminster City Council on the disposal of Dolphin Square.
More recently members of the set have been involved in defending challenges to NHS outsourcing, with real industry significance, in being an area of considerable public/private sector co-operation, as one facet of our growing expertise in public procurement and NHS advisory work generally.
The set has also advised clients on the UK and EU public law aspects of potential changes to the UK’s purchasing policy by the NHS’s central purchasing authority.
It has also advised clients on interrelated public law, commercial law and EU law requirements and risks in respect of a whole series of central government procurement contracts currently under scrutiny, including IT projects.
