Patricia Robertson QC, Ben Lynch QC and Deborah Horowitz have authored (with thanks to Richard Coleman QC for reviewing an earlier draft) this article, which explains the ways in which COVID-19 will have widespread ramifications, in the context of the legal principles relating to force majeure and the doctrine of frustration, for contracting parties in the UK and across the globe. The article considers those principles and addresses their impact as regards the international trade, food, construction, trade finance, banking, airline, pharmaceuticals, energy and insurance industries.
