Charles Béar QC is currently representing easyJet in a challenge to the Civil Aviation Authority’s decision to raise airport charges at Gatwick by over 20%. easyJet are alleging that the CAA reached an unlawful decision, that it acted unfairly and that it failed to pay proper regard to the significantly lower recommendations of the Competition Commission. This particular claim was referred to by the Competition Commission in its recent report which recommended amongst other things that BAA should sell up to 3 its airports.
