Judgment has been handed down by HHJ Keyser QC (sitting as a judge of the Chancery Division) in Green Deal Marketing Southern Ltd (“GDM”) v. Economy Energy Trading Ltd (“EE”) [2019] EWHC 507 (Ch) awarding GDM compensation of £1,049,600 under the Regulations; an award which appears to be the highest ever made by a Court under the Regulations. GDM ran a company providing field sales agents to EE, an energy company. The relationship was terminated in early 2017. The Court held EE wrongfully terminated its contract with GDM; that the 1993 Regulations applied to the relationship (in part because electricity constituted “goods” for those purposes) and, applying Lonsdale v. Howard Hallam, GDM was entitled to compensation assessed at £1,049,600.
