Product Liability
Fountain Court Chambers "offers expertise in most aspects of product liability with a notable strength in complex technical matters in industrial, aviation and marine contexts." (Chambers & Partners, 2009)
Members have substantial experience in major product liability litigation and in related areas. The experience and skills required in product liability litigation - including the ability to absorb and cross-examine on complex scientific and statistical issues; and familiarity with the procedural requirements of multi-party litigation (including legal aid and conditional fee questions) - are equally applicable in related forms of litigation, in particular health and safety at work and environmental pollution cases.
Members of Chambers have been instructed in many high-profile multi-party product liability cases, including those relating to:
- Whooping-cough vaccine
- Blood products (haemophilia/HIV/ hepatitis C)
- Aircraft
- Persona
- Third-generation oral contraceptives
Members were also involved in relation to Seroxat and in the Phillips enquiry into BSE. In the multi-party claims brought by uranium and asbestos miners in Southern Africa, members acted for the defendants (Connelly v RTZ and Lubbe v Cape Plc). Members of Chambers also have considerable experience in multi-party litigation outside the field of product liability - including the Lloyd's litigation and mass equal pay litigation.
Details of product liability and multi-party cases in which Members have been involved are set out in individual CVs.
