Intellectual Property
Members of Fountain Court have long had experience of advising and acting in disputes involving all aspects of intellectual and industrial property law, including trademarks and passing off, copyright, confidence and patents. Members have appeared in a wide range of trademark and passing off disputes, including Waterford Wedgwood Plc v David Nagli Ltd., Sea Island Cotton and Diehl KG's Application. Additionally, members have experience of appearing before the Copyright Tribunal and have acted in a number of cases concerning copyright and breach of confidence, including MCA Records v Mushroom Records, Arklow Investments Ltd v Maclean, AEI Rediffusion Music Ltd v Phonographic Performance Ltd., Murray v YRM, Medcalf v Mardell and Virgin Atlantic Airways v British Airways.
IT
Many members of Chambers have been involved in major litigation and arbitrations concerning computer technology, e-commerce and telecommunications. Recent cases include the following: the multi-million pound litigation concerning the supply of IT materials to Time computers and IBM's successor litigation, GE Information Services Ltd v Harbinger UK Ltd., arbitrations concerning the operation of electronic point of sale systems enabling payment to be made by credit card or debit card, an ICC arbitration concerning the provision of an air command and control centre, an arbitration relating to the failure of a computer system for the control of accident and emergency services. One member is part of the ICC working group on electronic commerce and has been co-opted onto an international ICC task force considering problems of jurisdiction and proper law in relation to the Internet.
Members have frequently advised and acted for the leading telecommunications providers in disputes relating to the design and supply of computer systems and telecommunications equipment as well as in relation to other telecommunication issues, including disputes arising out of the provision of mobile telephony in foreign countries and the acquisition of mobile network companies.
Construction
Chambers has a long history of acting in construction and engineering disputes. Experience includes the following cases: Siemens plc v Slough Heat & Power Ltd., Moore v Yakeley Associates Ltd., Milburn Services Ltd v United Trading Group (UK) Ltd., Department of the Environment v Thomas Bates Ltd. (the leading case on the liability in tort of a builder in negligence, decided at the same time as Murphy v Brentwood DC).
