Expert Witness Immunity – Patricia Robertson QC
Permission is being sought for a leapfrog appeal to the Supreme Court to test whether expert witnesses should continue to be immune from suit: Jones v Kaney (21 January 2010). The Claimant's case is based on Patricia Robertson QC's arguments for the abolition of expert witness immunity in her 2006 chapter on experts in Professional Negligence and Liability and her 2007 article on the same subject in the Journal of Professional Negligence (2007), both of which are cited from in the judgment.
