Appeal to the CoA in the Buncefield litigation

Richard Handyside QC was one of three QCs instructed by Simmons & Simmons to represent Shell in its appeal to the Court of Appeal in the Buncefield litigation.   The Court of Appeal allowed Shell’s appeal, holding that Shell was entitled to sue for losses suffered by Shell as a result of damage to property caused by the Buncefield Incident where Shell was a beneficial but not legal owner of the property at the time that it was damaged.
