Mr Justice Walker has granted judgment in favour of the Arch Cru Funds, represented by Richard Coleman QC and Giles Wheeler (instructed by Stephenson Harwood LLP), against Arch Financial Products LLP and its chief executive officer, Robin Farrell.  The judge upheld the Funds’ allegations that Arch, with Mr Farrell’s dishonest assistance, acted in breach of fiduciary duty, and negligently, in causing them to invest in the Club Easy student accommodation business.  It is one of the rare cases in which an English court has held that a fund manager acted in breach of duty in the management of its client’s investment portfolio.
