The Supreme Court has today handed down judgment in Williams v Central Bank of Nigeria [2014] UKSC 10 in which Guy Philipps QC and Edward Levey acted on behalf of the Central Bank in its successful appeal on the question of whether a 6 year limitation period applies to claims for dishonest assistance in a breach of trust and claims for knowing receipt.
Reversing the decision of the Court of Appeal (Sir Andrew Morritt C, Black and Tomlinson LJJ) the Supreme Court held by a majority that the limitation period does apply. As well as being the leading authority on the limitation period applicable to such claims, the judgment also confirms the distinction between different types of constructive trustee which had been challenged by the Respondent.
